TERMS AND CONDITIONS

1. Scope

These Terms and Conditions apply to orders placed through my online shop (checkout via Shopify) as well as to orders placed via quotation/invoice (e.g. custom-size prints, special orders, commissioned works).

3. Offer and Conclusion of Contract

a) Shop (Shopify checkout): The presentation of products does not constitute a legally binding offer. By completing the ordering process, you submit a binding offer. The contract is concluded as soon as I confirm the order or dispatch the goods (depending on the shop process).

b) Quotation / Invoice (Custom Size / Special Order / Commission): The contract is concluded when you accept my offer (e.g. by email) and/or pay the invoice.

4. Prices, Currency, VAT

All prices are stated in EUR. In accordance with Section 19 of the German VAT Act (UStG), no VAT is charged. Shipping costs are shown in the shop or communicated individually for orders placed by invoice.

5. Payment

a) Shop: Payment via Shopify Payments (e.g. card).

b) Custom-size prints / special orders / commissions: Payment by bank transfer (SEPA/SWIFT), generally in advance.

Bank fees: Any bank charges (in particular for SWIFT transfers) as well as currency conversion fees are to be borne by the customer.

6. Delivery and Shipping

I deliver worldwide wherever this is logistically possible. Delivery times, where stated, are non-binding estimates only.

For consumers, the risk of accidental loss of or accidental deterioration of the goods passes to you only upon delivery of the goods.

7. Retention of Title

The goods remain my property until full payment has been made.

8. Right of Withdrawal

Consumers have a right of withdrawal for standard goods (e.g. regular prints, available originals). Details can be found in the Withdrawal Policy.

There is no right of withdrawal in particular for commissioned works and custom-size prints, as these are made according to the customer’s specifications. Statutory warranty rights remain unaffected.

9. Limited Editions

Limited editions are restricted to the specific variant stated in each case (e.g. size, paper, handmade details, signature/numbering, year) and to the stated edition size. The same image content may appear in other formats/variants or as a standard print.

10. Returns / Transport Damage (Practical Notes)

Details on shipping, delivery and returns can be found on the Shipping & Delivery / Returns page.

Please report any obvious transport damage, if possible within 7 days, with photo/video evidence. Your statutory rights remain unaffected.

11. Warranty

The statutory warranty rights apply.

12. Copyright and Usage Rights

By purchasing, you acquire ownership of the physical work/print. Copyright and usage rights (e.g. reproduction, reprinting, merchandising, commercial use) remain with me unless otherwise expressly agreed in writing.

I reserve the right to publish motifs, reproduce them (e.g. as prints), and create new versions/variations/repetitions (including 1:1 reproductions); uniqueness relates only to the respective physical object.

I may ask customers whether a work can be made temporarily available for an exhibition; this is voluntary and may be declined.

13. Liability

I am liable without limitation in cases of intent and gross negligence as well as for injury to life, body or health. In cases of slight negligence, I am only liable for the breach of essential contractual obligations (cardinal obligations), and limited to the typically foreseeable damage.

14. Consumer Dispute Resolution

I am neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Final Provisions

German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The contract language is German. Should any provision be invalid, the remainder of the contract shall remain unaffected.
